               Introduction

1.         At the fortieth session as part of the discussion on DGAC’s proposal (ST/SG/AC.10/C.3/2011/22) to amend Special Provision 135 to take account of the introduction of criteria for environmentally hazardous substances, DGAC was asked to provide a document identifying other substances that may be similarly affected by the introduction of Environmentally Hazardous Substance (EHS) criteria.  DGAC agreed to carry out a preliminary analysis to provide a basis for further work by the Sub-Committee in this area.

2.         In general, similarly affected substances are considered to be those which are assigned a special provision indicating the substance is not subject to the regulations (e.g., “This substance is not subject to the Regulations when …”). It is possible that the classification status of some substances assigned this type of special provision may have changed due to the introduction of EHS criteria. 

3.         In addition consideration should be given to:

-        SP 223 to the extent that it takes account of EHS criteria. In particular, whether EHS criteria are “defining criteria of a Class or Division”; and

-        SP 276 to clarify whether EHS criteria take precedence in the case of Aviation Regulated Liquid or Solid entries (UN 3334, 3335).

               Discussion

4.         The relevant special provisions and the substances to which they are linked are provided in the annex. Many of the special provisions indicate a substance or range of concentrations of substances is not subject to the Regulations. It will not always be possible to ascertain whether these substances do or do not meet the EHS criteria. In these instances it may be appropriate to add to the special provision qualifying text such as “provided the substance does not meet the criteria.”

5.         The Sub-Committee is invited to take note of the list in the annex and decide upon an appropriate course of action.  


List of special provisions and relevant substances potentially requiring revision based on the introduction of EHS criteria

1.         SP 32 “This substance is not subject to these Regulations when in any other form.”

Assigned to: UN 1346 Silicon Powder Amorphous

2.         SP 37 “This substance is not subject to the Regulations when coated.”

Assigned to: UN 1398 Aluminium Silicon Powder Uncoated

3.         SP 38 This substance is not subject to these Regulations when it contains not more than 0.1% calcium carbide.

Assigned to: 1403 Calcium Cyanamide with more than 0.1% calcium carbide

4.         SP 39 This substance is not subject to these Regulations when it contains less than 30% or not less than 90% silicon.

Assigned to: UN 1408 Ferrosilicon with 30% or more but not more than 90% silicon

5.         SP 45 Antimony sulphides and oxides which contain not more than 05% of arsenic calculated on the total mass are not subject to these Regulations.

6.         SP 47 Ferricyanides and ferrocyandides are not subject to these Regulations.

7.         SP 59 These substances are not subject to these Regulations when they contain not more than 50% magnesium.

Assigned to: UN 1869 Magnesium or Magnesium alloys with more than 50% magnesium in pellets turnings or ribbons.

8.         SP 62 This substance is not subject to the Regulations when it contains not more than 4% sodium hydroxide.

Assigned to: UN 1907 Soda Lime with more than 4% sodium hydroxide

9.        SP 65 Hydrogen peroxide aqueous solutions with less than 8% hydrogen peroxide are not subject to these Regulations.

Assigned to: UN 2984 Hydrogen Peroxide Solution with not less than 8% but less than 20% hydrogen peroxide

10.       SP 66 Mercurous chloride and cinnabar are not subject to these Regulations.

Assigned to:  UN 2024 Mercury Compound Liquid, NOS; UN 2025 Mercury Compound Solid, NOS

11.       SP 138 P-Bromobenzyl cyanide is not subject to these Regulations.

12.       SP 169 Phthalic anhydride…

Assigned to: UN 2214 Phthalic Anhydride with more than 0.05% maleic anhydride; UN 2698 Tetrahydrophthalic Anhydrides with more than 0.05% maleic anhydride

 

13.       SP 177 barium sulphate is not subject to these regulations.

Assigned to: UN 1564 Barium Compounds NOS

14.       SP 208 The commercial grade of calcium nitrate fertilizer, when consisting mainly of a double salt (calcium nitrate and ammonium nitrate) containing not more than 10% ammonium nitrate and at least 12% water of crystallization, is not subject to these Regulations.

15.       SP 223 If the chemical or physical properties of a substance covered by this description are such that when tested it does not meet the established defining criteria for the class or division listed in Column 3 of the Dangerous Goods List of Chapter 3.2, or any class or division, it is not subject to these Regulations.

Assigned to: Multiple substances. Consideration should be given as to whether the text should be clarified with respect to EHS criteria. Some may consider EHS criteria as not being “defining criteria of a class or division”.

16.       SP 226 Formulations of these substances containing not less than 30% non-volatile, non-flammable phlegmatizer are not subject to these Regulations.

17.       SP 241 pertaining to nitrocellulose

Assigned to: UN 2557 Nitrocellulose with not more than 12.6% nitrogen by dry mass, Mixture With or Without Plasticizer, With or Without Pigment

18.      SP 242 Sulphur is not subject to these Regulations when it has been formed to a specific shape (e.g. prills, granules, pellets, pastilles or flakes).

19.       SP 249 Ferrocerium, stabilized against corrosion, with a minimum iron content of 10% is not subject to these Regulations.

Assigned to:  UN 1323 Ferrocerium

20.       SP 252 Provided the ammonium nitrate remains in solution under all conditions of transport, aqueous solutions of ammonium nitrate, with not more than 0.2% combustible material, in a concentration not exceeding 80%, are not subject to these Regulations.

Assigned to: UN 2426 Ammonium Nitrate Liquid (hot concentrated solution)

21.       SP 271 pertaining to nitroglycerin / sugar mixtures

Assigned to: UN 0143 Nitroglycerin, Desensitized with not less than 40% non-volatile, water-insoluble phlegmatizer, by mass

22.       SP 276 This includes any substance which is not covered by any of the other classes but which has narcotic, noxious or other properties such that, in the event of spillage or leakage on an aircraft, annoyance or discomfort could be caused to crew members so as to prevent the correct performance of assigned duties.

Assigned to: UN 3334 Aviation Regulated Liquid NOS; UN 3335 Aviation Regulated Solid NOS Note the criteria for EHS do not take precedence so that multimodal disharmony in classification is possible. 

23.       SP 305 These substances are not subject to these Regulations when in concentrations of not more than 50 mg/kg.

24.       SP 332 Magnesium nitrate hexahydrate is not subject to these Regulations.

               介绍

1.         在第四十次会议上,作为关于DGAC所提交的考虑对环境有害物质(EHS)标准的引入来修订特殊规定135的提案(ST/SG/AC.10/C.3/2011/22) 的讨论的一部分,DGAC应提交确认其他可能由引入EHS标准造成类似影响的物质的文件。DGAC同意实行初步分析以提供委员会在此领域做进一步研究的依据。

2.         通常情况下,类似被影响的物质被认为是指定了特殊规定说明其不受规章范本限制(例如:此物质在如下情况下不受规章范本限制)。 EHS标准的引入可能改变某些适用于这类特殊规定的物质的危险性分类。

3.         另外还需考虑到:

-        特殊规定223考虑到EHS标准的部分。特别是EHS标准是否“作为类或项的判定标准”。和

-        特殊规定276需澄清EHS标准是否优先用于空运中受管制的液体和固体条目(UN33343335)。

               讨论

4.         附件提供了相关的特殊规定以及与特殊规定相关的物质。许多特殊规定说明物质或在一定浓度范围的物质不受规章范本限制。可能并不总是能确定这些物质是否符合EHS标准。在这些情况下可能要在特殊规定里加一些文字阐明,如“物质不符合本标准的话”。

5.         请分委员会审阅附件中的清单并决定恰当的做法。

2. 特殊规定37“本物质涂层后不受本规章限制”

3. 特殊规定38“本物质含有不大于0.1%碳化钙时不受本规章限制”

UN1403:碳化钙含量大于0.1%氰氨化钙

4. 特殊规定39“本物质含硅小于30%或不小于90%时不受本规章限制”

UN1408:硅含量大于等于30%但不高于90%的硅铁

5.          特殊规定45锑的硫化物和氧化物,如按总质量计算的砷含量不大于0.5%,则不受本规章限制”

见:UN1549固态无机锑化合物,未另作规定的;UN3141液态无机锑化合物,未另作规定的

6. 特殊规定47“铁氰化物和亚铁氰化物不受本规章限制”

见:UN1588 固态无机氰化物,未另作规定的。

7. 特殊规定59:“本物质镁含量不超过50%的情况下不受本规章限制”

见:UN1869 镁或镁合金,丸状、旋屑或带状,含镁大于50%

8.         特殊规定62:“本物质氢氧化钠含量不大于4%时不受本规章限制”

见:UN1907碱石灰,氢氧化钠含量大于4%

9.        特殊规定65:“过氧化氢含量小于8%的过氧化氢水溶液不受本规章限制”

见:UN2984 过氧化氢水溶液,过氧化氢含量8% - 20%

10.       特殊规定66:“氯化亚汞和硫化汞不受本规章限制”

见:UN2024 液体汞化合物,未另作规定的;UN2025 固体汞化合物,未另作规定的。

11.       特殊规定138:“对溴氰苄不受本规章限制”       

见:UN1694 液态溴苄基氰;UN3449固态溴苄基氰

12.       特殊规定169:“邻苯二甲酸酐……

见:UN2214邻苯二甲酸酐,含马来酸酐大于0.05% UN2698 四氢化邻苯二甲酸酐,含马来酸酐大于0.05%

13.       特殊规定177:“硫酸钡不受本规章限制”

见:UN1564 钡的化合物,未另作规定的。

14.   特殊规定208:“硝酸铵含量不大于10%且结晶水含量至少为12%的由复盐(硝酸钙和硝酸铵)组成的商品级的硝酸钙化肥不受本规章限制”

见:UN1454 硝酸钙

15.        特殊规定223:本项内容所包括的物质,如果化学物理性质在试验时不符合3.2章危险货物列表第3栏所确定的类和项,或任或任何其他类或项的判定标准,不受本规章限制。

见:多种物质。应考虑是否要根据EHS标准阐明文本。有些人认为EHS标准不是“作为类或项的判定标准”。

16.        特殊规定226:“本物质配方含有不低于30%不挥发,不易燃的减敏剂时不受本规章限制”

见:UN3251 异山梨醇-5 一硝酸酯

17.       特殊规定241:关于硝化纤维素

见:UN2557 硝化纤维素,按干重含量不大于12.6%,含或不含增塑剂,含或不含颜料的混合物。

18.        特殊规定242:当硫的形状为特殊形状时(如小球,颗粒、丸状,锭状或片状)不受本规章限制。

见:UN1350

19.        特殊规定249:铁含量最小10% 的进行过防腐蚀稳定处理的铈铁合金不受本规章限制。

见:UN1323 铈铁合金

20.        特殊规定252:如果硝酸铵在一切运输条件下都在溶液中,含可燃物质不大于0.2%,浓度不大于80%的硝酸铵水溶液不受本规章限制。

见:UN2426 液态硝酸铵(热浓溶液)

21.       特殊规定271:关于硝化甘油/糖混合物。

见:UN0143减敏硝化甘油,按重量含有不低于40%不挥发、不溶于水的减敏剂。

22.        特殊规定276:包括不在任一其他类别之内但具有麻醉性,毒性或是其他性质,如在飞机上发生溢出或泄漏的时可能造成机组成员的烦躁或不适以致不能正确执行任务的任何物质。

见:UN3334 航空管制液体,未另作规定的;UN3335 航空管制固体,未另作规定的。注意不优先考虑EHS标准时在多式联运可能出现不一致。

23.       特殊规定305:这些物质浓度不超过50mg/kg时不受本规章限制。

见:UN2315多氯联苯,液态;UN3151液态多卤联苯或液态多卤三联苯;UN3152固态多卤联苯或固态多卤三联苯UN3432固态多氯联苯

24.       特殊规定332:六水合硝酸镁不受本规章限制

见:UN1474 硝酸镁

注:特殊规定117281299(纤维质,鱼粉,棉花等),141蓖麻子),142大豆豆粕),144145146含酒精饮料),168(石棉),190气溶胶),191(小容量气瓶)不予考虑。
